Municipalitu competency

    Municipalities in a frames of the law, in agreement with the principle of suppsidiarity, have wrights on there districts to accomplishis there works from public interest of local meaning, which are not preclude from there competence or they are not in competence at organs of state .

(1) Municipalities independently, in a frames of the law, arranges and accomplishis works of public interest in local meaning, affirmed with this or other law and they are responsible for there accomplishing.
(2) With the law that are affirmed other competences of the municipality, get defined sources of financing for accomplishing of the competences.
(3) Competences of item (1) of this member by some rule are defined and excluded and can not be taken or limited, except in cases determined with a law.

(1) Municipalities are competence for accomplishing of this works:
1. Town planning(urbanistic and rural) planning, emission of licence for construction from local meaninig, affirmed with law, arranging of environment and arranging of constructive land;
2. Protection of the environment and nature – measures for protection and prevent contamination of water, air,land, protection of nature, protection of tumult and unionization radiation;
3. local economic develop – planning of local economic developing; arranging of developed and structure priorities; leading of local economic politic; support of develop of small and medium firms and entrepreneurship at local level and in that meaning, participation in establishment and develop of local net of institutions and agencies and promoting of partnership;
4. Comunal activities – supply of water for drinking; deliver of technological water; abduct and refine of wasted water; public lighting; abduct and treatment of atmosphere waters ; keeping of public tidiness; collecting , transporting and handdealing with communal hard and technological waste; arranging and organazing of public local transport for travellers;supply with natural gas and heat energy; keeping of graves , cemetery , crematorium and giving of funeral services ; constructing , keeping , reconstruction and protection of local traffic, streets and other infrastructure objects; regulation of traffic regime; construction and keeping of traffic signals ; construction and keeping of public parking space; removing of unproperly parked cars ; removing of old vehicle from public spaces;constructing and keeping of markets; cleaning of chimney; keeping and using of parks,green surface , park forest and recreation area; regulation, keeping and using of river – bed in urbanistic parts; naming of streets, squares ,bridges and other infrastructure objects;
5. Culture – institutional and financial support of the cultural iinstitutions and projects; caring for folklores, traditions, old crafts and similar cultural values; organizing of cultural manifestations; stimulating of various specific forms of creating;
6. Sport and recreation – developing of massive sport and recreational activities; organizing of sport manifestations; maintaining and construction of sport objects; supporting of sport unions;      
7. Social care and protection of children – kindergartens and abodes for old people (property, financing, investments and maintaining); realizing of social care for disable persons; children without parents and parents care; children with educational – social problems; children with special needs; children from one parent families; children from streets; persons exposed to social risk; addicted persons to drugs and alcohol; rising of conches of the inhabitants; habitats for persons with social risk; realizing of wrights and education of children at preschool age. Providing of this competences are in agreement with the National program for developing of the social protection;
8. Education - foundation, financing and administration of elementary and secondary schools with corporation of the central government, considering the law, organizing of transport and feeding of students and there seating in to school abodes;
9. Health protection – managing with the net of public health organizations and objects from primary health protection which should be presented at all boards of every health organizations in public possession of local self governmant, health education; promotion of health; preventive activities; protection of health of workers and protection during there works; health control of environment; control of diseases and contagious; assistance of patients with special needs (for example, mental health, abusing of children etc.) other areas that will be confirmed with law;
10. Providing of preparation and taking safety measures for protection and saving of citizens and material goods from war destroying, natural disasters and other accidents and consequences evoked by them;
11. Fire prevention that is provided by territorial fire preventive units;
12. Supervision of providing of there competency
13. Other things assigned with the law.
(2) Competences from act (1) of this member are provided considering standards and procedures confirmed with a law.
(3) With a law are confirmed competences that Municipality will be obligatory provides.

(1) Organ of the state government could delegates providing of specific things from there competence of the Mayor, considering law.
(2) At cases from act (1) of this article are transferring resources predicted in the Budget of Republic of Macedonia for performing of that works.
(3) Method of performing works from act (1) of this article can be adapted of the local conditions with respecting of  standards confirmed with a law.
(4) Organ of the state government from act (1) of this article is subsidiary responsible for providing of delegated works.

(1) To provide competences, Municipalities can establishes public services considering law.          
(2) Municipality can delegates providing of defined works from public interest of local meaning of other legal or physical persons, based on contract for performing of works from public interest considering the law.
(3) Municipality is subsidiary responsible for providing of works from public interest of acts (1) and (2) of this article.
